Guest Rental Agreement

VACATION AT ITS FINEST, LLC.

 

Please read your vacation rental agreement carefully before you begin your vacation.

Any payment received by Vacation at its Finest, LLC. for occupancy of vacation rental property indicates the acceptance of the terms of our vacation rental agreement in full. All policies are strictly enforced. It is the responsibility of all guests visiting the rental property to be familiar with the rental agreement and policies within.

 

Rental Policies

 

Check-In / Check-Out Time

Check-in begins at 4:00 PM (CST). Check-out time is 10:00 AM (CST). No early arrivals or late departures permitted. Refunds will not be given for late arrivals or early departures. If the check-out time is not met, a half day of rent will be charged.

 

 Reservation Deposit and Guidelines

A payment of 50% of the total charges is due at the time of booking. Visa, Mastercard, Discover or an Electronic check/ACH Bank draft are accepted. No holds can be placed on properties without a deposit.

We accept reservations up to one year in advance. We reserve the right to correct or adjust rates to the published rates at the time of the reservation if they have been misquoted due to human and/or computer error.

Most of our properties require a minimum stay of three (3) nights. Longer stays may be required during peak seasons and holidays. A minimum stay of six (6) nights may apply at some properties during peak and holiday periods, with Saturday arrival and Saturday departure.

 

Payment

The balance of the reservation is due sixty (60) days prior to the arrival date. Visa, Mastercard, Discover or an Electronic check/Ach Bank draft are accepted. Failure to make the final payment 60 days prior to arrival will result in a cancellation of your stay and forfeiture of your reservation deposit. Vacation at its Finest is charged a bank fee for returned checks or ACH bank drafts. Any returned check or ACH bank draft will result in a $50 fee.

 

Refundable Security Deposit

Guests will be charged a $500 security deposit that will be fully refunded within 14 days of departure provided the following house rules are met.

- No damage is done to the property or its contents

- No contraband or pets during your stay

- No smoking in the property

- No glass by pool areas

- All debris and garbage in the house and around the pool area are placed in the garbage cans

- No bonfires or open flame on the rental property

- Dirty dishes are placed in the dishwasher and cleaned

- All keys, garage door openers, fobs, wristbands remain on the property or replacement fees will be assessed if lost or taken

- All charges accrued during the stay are paid prior to departure

- All linens, towels, blankets remain on property and undamaged

- The guest is not evicted by the property manager or authorities

- The property is left in a neat and orderly condition and doesn’t require additional or above normal cleaning

- No violations of rental, state, county or homeowners association policies

- Maximum occupancy is not exceeded

- An event, party or wedding held on the property without prior permission from the property manager

- Rearranging or moving any items from property

  

Insurance

Vacation Rental Insurance has been made available with your reservation. Vacation Rental Insurance provides coverage for the loss of prepaid, non-refundable expenses due to certain unforeseeable circumstances that may jeopardize your vacation investment and force you to incur unplanned expenses. Trip Cancellation and Trip Interruption coverage is available for events such as a sickness or injury of yourself, family member or traveling companion; flight delays due to adverse weather; interruptions of road service; terrorist acts; and mandatory evacuations. The plan also includes other valuable coverages such as Medical and Dental, Baggage, and Emergency Assistance and Transportation in addition to useful services such as identity theft, concierge and 24/7/365 emergency assistance. Vacation Rental Damage Protection

As a part of your stay, you may purchase a Vacation Rental Damage Protection plan designed to cover unintentional damages to the rental unit interior that occur during your stay provided they are disclosed to management prior to check-out. If purchased, the policy will pay a maximum benefit of $3,000. Any damages that exceed $3,000 or are not covered under the plan will be charged to the credit card on file. If, during your stay at one of our rental properties, an insured person causes any damage to real or personal property of the unit as a result of inadvertent acts or omissions, the Insurer will reimburse the Insured for the cost of repair or replacement of such property up to a maximum benefit of $3,000. The Vacation Rental Damage Protection can be purchased up to, and including at, check-in. By submitting payment for this plan, you authorize and request Customized Services Administrators, Inc. d/b/a Generali Global Assistance & Insurance Services to pay directly Vacation At Its Finest, LLC any amount payable under the terms and conditions of the Vacation Rental Damage. Please contact Vacation At Its Finest, LLC directly if you do not wish to participate in this assignment.

 

Cancellation

If you need to change or cancel your reservation, Vacation at its Finest must be notified in writing sixty (60) days in advance of your arrival. If Vacation at its Finest is notified 60 days prior to your arrival, you will receive 100% refund less the $300 cancellation fee. You will forfeit the full amount of payment if cancellation occurs within fifty-nine (59) days of arrival or less. No refund exceptions will be given for any circumstances.  

 

Damage Policy

Guests are responsible for the property, its contents, and themselves during occupancy. Guests must lock windows and doors securely when they are not on the premises. After departure, Vacation at its Finest will inspect the home for damage, missing items, and abnormally dirty appearance. If Vacation at its Finest determines that damage is present, the security deposit will be forfeited. An additional charge may be assessed for damages that exceed the security deposit.

When a guest provides notice to Vacation at its Finest prior to check-out of accidental or inadvertent damage to the property, Vacation at its Finest will investigate the damage to determine if the damage appears to have been caused by accidental or inadvertent actions along with the costs of the repairs or replacements.  Such determination shall be made in the sole and absolute discretion of Vacation at its Finest provided there is some reasonable basis for making such a determination. 

Guest authorizes Vacation at its Finest to charge their credit card or bank ACH on file for damages in excess of $1500 that are not covered by the damage insurance.

 

Maximum Guests

The maximum number of guests per unit is based on the ability to house our guests comfortably and safely. If the maximum occupancy is exceeded, you may be asked to vacate the property and forfeit any rental payments.

 

Minimum Age Requirement

You must be twenty-five (25) years old to rent property from Vacation at its Finest. Any young adult or student must be accompanied by a responsible parent or guardian that stays at the unit the entire reservation. Proof of age or identification may be required from all guests prior to arrival. Guests who violate this policy are subject to immediate eviction and forfeiture of all payments. In accordance with Florida State Chapter, reservations made under false pretense are null and void. If under twenty-five (25), Check-in will not be allowed and or guests will be asked to vacate the property. This policy includes reservations made by parents or guardians who do not check-in with young adults or who fail to stay the entire length of the reservation.

 

Spring Break (March / April)

For reservations in March or April, it is required that one (1) parent or guardian over the age of 25 be present and staying in the property for every three (3) guests between the ages of 15 and 25. Proof of age is required by all guests and all homes are subject to inspection upon guest arrival to ensure compliance. Violations will result in immediate eviction and forfeiture of all booking charges.

 

No Subletting

Your reservation is not transferrable to any other party. The property may not be sublet.

 

Property Selections

Vacation at its Finest will reserve for you the specific unit selected at the time of your reservation upon the receipt of your deposit and acknowledgement of the Guest Rental Agreement.  If the property that you’ve selected becomes unavailable for any reason, for example, maintenance, owner usage, or other issues, we will provide a full refund or an opportunity to stay in an equivalently priced accommodation if available. Guests will be limited to a full refund or similar accommodation at their election.  In no event will Vacation at its Finest be responsible for any direct or indirect costs, expenses, fees or other consequential damages resulting from the unavailability of a specific accommodation.

 

Pets

Pets are only allowed in pet friendly properties and must be approved by Vacation at its Finest prior to your stay. If a pet is permitted, a non-refundable pet fee of $500 will be charged to the guest. Guests who violate this policy will lose their $500 security deposit and incur the expense of any necessary cleaning. Violations may also result in immediate eviction and forfeiture of payments made.

 

No Smoking

Smoking is not permitted at any property managed by Vacation at its Finest. Guests who violate this policy will lose their security deposit and incur the expense of any necessary cleaning. Violations may also result in immediate eviction and forfeiture of rent.

 

Wedding / Events

All weddings or events must be pre-approved in writing by Vacation at its Finest and an event fee will be assessed based on the venue and property. All events must meet County restrictions, Homeowners Association restrictions and follow local noise restrictions. The guests are responsible for any permits necessary for beach weddings. There is a maximum number of people permitted to be on the property for a wedding/event and this number will be established by Vacation at its Finest prior to. An Event Addendum that details the guidelines specific to the property will be required to be signed in addition to this Agreement. Violations may result in immediate eviction and forfeiture of payments made.

 

Housekeeping

Your vacation accommodations will be cleaned to quality standards prior to your arrival and after your departure. Upon arrival, if you find the quality of cleaning is not to your standards, please notify us within 48 hours of your arrival for our team to resolve any issues. You will be responsible for the cleaning of your unit during your stay and for leaving the unit in good condition at check-out. We respectfully request that you remember that you are staying in someone's home during your vacation; please treat it with the care you would your own home. If units are found abnormally dirty at check-out your security deposit will be forfeited. All stays will be subject to a cleaning fee. Additional cleanings can be arranged during your stay for an additional fee if you prefer.

 

Departure Condition / Instructions

The normal departure cleaning fee is priced for guests who leave the unit broom clean so that we can focus on sanitizing. Please leave the unit in the same condition as you found it. If our housekeepers have additional cleaning to perform, your security deposit will be forfeited. If you have difficulty keeping a clean house, you may opt to pay to have daily or mid-week cleaning. To avoid additional cleaning charges, leave the house nearly broom clean which is defined as:

- Wash and store the dishes in cabinets; the last load of dishes is allowed to be running in the dishwasher
- Remove garbage from the inside of the house and place bagged trash in the outdoor garbage cans
- Organize neat & orderly with kitchen items stored in cabinets and all remotes placed back on TV stands
- Clean any food or spills from refrigerator, counters, floors, appliances
- Burn off grease & food from the outdoor grill

- Close and lock all outside doors and windows.
- Clean off sand off any provided items such as golf cart, bicycles, beach chairs, beach toys, etc.

 

Maintenance

During your stay, promptly report any maintenance problems to Vacation at its Finest. No refund or rate adjustment will be made for unforeseen failures such as the supply of electricity, water, pool filtration systems, air conditioning, telephone, television or cable service, appliances, etc.

 I understand that no rate adjustment will be given if items are resolved within 48 hours.

 

Beach Towels

Please bring your own beach and/or pool towels as we do not permit bath towels or linens to be taken form the unit except for laundering.

 

Security of Personal Property

We are not responsible for any acts of theft or vandalism, or other damages to any personal property or for personal items left by guest in the accommodation at departure.

 

Hurricanes and Severe Weather

Guests may be entitled to a refund or partial refund in the event that a governing office issues a “Mandatory Evacuation” order for the location of your rental property. 

Refunds will not be issued for shortened stays due to anticipated hurricanes, tropical storms or other inclement weather.

 

Pandemic(s)

Refunds for Pandemics that may render the unit or travel unavailable will not be issued by Vacation at its Finest under any circumstances.

 

Bike, Golf Cart and Pool Liability

By signing the Agreement electronically, guests who rent units that provide private swimming pools, complementary Golf Carts and/or bikes further agree to the express terms, conditions and waivers set forth in the following attachments:  Bike Liability & Damage Addendum, Pool Use Liability & Damage Addendum and the Golf Cart Liability & Damage Addendum.

 

 

 

Conditions & Limitations

 

Notices

All notices required or permitted under this Agreement will be in writing and sent by certified mail, return receipt requested, by reputable oversight courier, by hand delivery, or by email. The notice address for Manager is: MAIL – Vacation at its Finest, LLC., 13 W Henry Ct, Santa Rosa Beach, FL. 32459; EMAIL – info@vacationatitsfinest.com, and the notice address for Owner is as specified for the Primary Contact on the first page of this Agreement. Any notice sent in the manner set forth above shall be deemed sufficiently given for all purposes hereunder (i) in the case of certified mail, on the third business day after deposited in the U.S. mail, (ii) in the case of overnight courier or hand delivery, upon delivery, and (iii) in the case of email the date of the e-mail as evidenced by a delivery receipt. Either party may change its notice address by giving written notice to the other party by the means specified in this paragraph.

 

Applicable Law

This Agreement shall be governed by, construed under, and enforced and interpreted in accordance with the laws of the State of Florida, excluding its principles of conflicts of laws.

 

Severability

If any term or provision of this Agreement is held illegal, invalid or unenforceable, such illegality, invalidity or unenforceability shall not affect the legality, validity or enforceability of the remainder of this Agreement.

 

Venue, Jurisdiction, and Attorneys' Fees

The exclusive venue for any civil action related to this Agreement or the course of dealings between the parties is the County and Circuit Courts sitting in Walton County, Florida.  The parties hereby submit to the personal jurisdiction of all the courts in the previous sentence and agree not to challenge such jurisdiction. In any action, suit, or proceeding to enforce or interpret the terms of the Agreement or to collect any amount due hereunder, the prevailing party shall be entitled to reimbursement for all costs and expenses reasonably incurred in enforcing, defending, or interpreting its rights hereunder, including, but not limited to, all attorneys' fees and the costs expended in determining entitlement to and amount of such fees.

 

Headings

Section and other headings contained in this Agreement are for convenience of reference purposes only and are in no way intended to define, interpret, describe, or limit the scope, extent or intent of this Agreement or any provision hereof.  Use of a gender specific term is immaterial, and the term applies as appropriate to the gender of the person to whom reference is.

 

Force Majeure

Notwithstanding any other provision of this Agreement, no party to the Agreement shall be deemed in default or breach of this Agreement or liable for any loss or damages or for any delay or failure in performance (except for the payment of money) due to any cause beyond the reasonable control of, and without fault or negligence by such party.

 

Indemnification of Manager

Guest will defend, indemnify and hold Vacation at its Finest, LLC. (including its members, officers, and employees), harmless from any and all claims, liabilities, losses, costs and expenses (including, but not limited to, reasonable attorneys' fees and costs of suit) incurred by Vacation at its Finest, LLC. as a result of or arising out of the breach of this Agreement by guest, except to the extent such claims, demands and actions arise from the negligence or willful misconduct of Vacation at its Finest, LLC.  The indemnified party shall promptly notify the indemnifying party of any such claim and shall, at the request and expense of the indemnifying party, cooperate in the investigation and defense of such claim.

 

Indemnification of Owner of the Property

Guest will defend, indemnify and hold the Owner of the Property. (including its members, officers, and employees), harmless from any and all claims, liabilities, losses, costs and expenses (including, but not limited to, reasonable attorneys' fees and costs of suit) incurred by the Owner of the Property as a result of or arising out of the breach of this Agreement by guest, except to the extent such claims, demands and actions arise from the negligence or willful misconduct of the Owner of the Property.  The indemnified party shall promptly notify the indemnifying party of any such claim and shall, at the request and expense of the indemnifying party, cooperate in the investigation and defense of such claim.

 

Liability

Vacation its Finest, LLC. and the Homeowners of this property are not liable for loss, damage of property, injury to the guests during their stay on the premises. Guest will release, waive, discharge and covenant not to sue the managers or owners of this property, its officers, staff, agents, or employees for any liability, claim and or cause of action arising out of or related to any loss, damage or injury, including death that may be sustained by me or to any property belonging to me arising out of use of the house or property.

Guest will defend, indemnify and hold Vacation at its Finest, LLC. (including its members, officers, and employees), harmless from any and all claims, liabilities, losses, costs and expenses (including, but not limited to, reasonable attorneys’ fees and costs of suit) incurred by Vacation its Finest, LLC as a result of or arising out of the breach of this Agreement by guest, except to the extent such claims, demands and actions arise from the negligence or willful misconduct of Vacation its Finest, LLC.  The indemnified party shall promptly notify the indemnifying party of any such claim and shall, at the request and expense of the indemnifying party, cooperate in the investigation and defense of such claim.

 

Waiver of Jury Trial

BY ENTERING INTO THIS AGREEMENT, THE PARTIES KNOWINGLY AND VOLUNTARILY WAIVE THE RIGHT TO A JURY TRIAL AS TO ANY CLAIMS A PARTY MAY CLAIM TO HAVE AGAINST THE OTHER WHICH ARISES OUT OF THIS AGREEMENT OR THE COURSE OF DEALINGS BETWEEN THE PARTIES.

 

 

Entire Agreement

This Agreement constitutes the entire agreement between the parties and supersedes any prior understanding, marketing or agreement among them respecting the subject matter hereof.  There are no representations, arrangements, understandings or agreements, oral or written, relating to the subject matter of this Agreement, except those fully expressed herein.  No waiver of any provision hereof shall be valid or binding on the parties hereto, unless such waiver is in writing and signed by or on behalf of the parties hereto, and no waiver on one occasion shall be deemed to be a waiver of the same or any other provision hereof in the future.
